Future Loss of Income

If you have been involved in a motor vehicle accident and suffered injuries that do not resolve as of the date of trial you may be entitled to future loss of income even if you have continued to work at the same job you had at the date of the accident.

If your injuries leave you less marketable as an employee then there is a strong argument to be made that you may suffer an income loss in the future. You do not need to prove the likelihood of a loss of income in the future on a balance of probabilities. So long as there is a strong possibility that you may suffer such losses then the court may award you significant compensation. Sometimes this compensation is referred to as Loss of a Capital Asset.

Even relatively minor injuries such as soft tissue injuries may entitle you to make such a claim. You would be well advised not to settle with ICBC without obtaining advice in this regard in advance from a lawyer familiar with this area of law.
